1. Agreement
These Terms of Service ("Terms") are a legal agreement between you and Harry Howarth, an individual trading as Duckin ("Duckin", "we", "us"). They cover the Duckin app and every service we provide through it. By creating an account or using the app you accept these Terms and our Privacy Policy. If you do not agree, do not use Duckin.
2. Who Can Use Duckin
You must be at least 13 years old to use Duckin. The app asks your age before you can create an account, and you must answer truthfully. In some countries the minimum age for consenting to online services without a parent is higher (16 in parts of the European Economic Area), and where that applies to you, that higher age applies instead. If you are under 18, a parent or guardian must review and agree to these Terms on your behalf, and should supervise your training. You are responsible for keeping your sign-in credentials secure and for everything done under your account.
3. Health and Safety: Train at Your Own Risk
Duckin is a training tool. It provides timers, drills, combination callouts, conditioning and stretching sessions, and estimates such as calories and training load. It is not medical, health, physiotherapy, or nutrition advice, and it is not a substitute for a qualified coach. The coaches in the app are recorded voices and characters. No real person is watching or supervising you.
Combat-sports training, including bag work, shadowboxing, conditioning, stretching, and sparring, is a dangerous recreational activity. It carries obvious and inherent risks of injury, including cuts, bruising, sprains, strains, fractures, joint and tendon damage, head injury, concussion, heart problems, and in rare cases serious permanent injury or death. These risks exist however carefully you train and whatever the app calls.
Before you start, and before you increase intensity, get clearance from a doctor, especially if you are pregnant, have a heart, blood-pressure, or breathing condition, have had a head injury, or have any other injury or medical condition. Warm up, train within your limits, and stop immediately if you feel pain, dizziness, shortness of breath, chest discomfort, or unwell. Settings that change the pace or length of a session are for your convenience and do not make a harder session safe for you.
You are responsible for your training space and equipment: a bag that is securely hung or mounted, enough clear room, a safe floor, and suitable gloves, wraps, and protective gear. We never see or inspect any of it. Sparring Rounds is a round timer only. If you train or spar with anyone else, you are responsible for choosing a suitable partner, agreeing the intensity, using protective equipment, and arranging supervision. Any figure the app shows, including calories, strike counts, and training load, is an estimate and must not be relied on for medical or dietary decisions.
You choose whether to train, how hard, and for how long, and you do so voluntarily, accepting these risks. To the fullest extent permitted by law, including any civil liability legislation that applies, we are not liable for any injury, illness, or death arising from your training or from following anything the app calls or shows.
4. Public Content and Community Rules
Duckin does not offer user-to-user messaging. There is no chat and there are no direct messages. Where the Arena is open, it carries a Message Board that only Duckin posts to, and leaderboards and leagues that display your username, display name, tier, streak, weekly scores, and country if you set one. Community features may be closed or limited at times.
The content you make public is therefore limited, but it is still subject to rules. Your username and display name must not be abusive, threatening, hateful, sexually explicit, discriminatory, deceptive, or unlawful, must not impersonate another person or organisation, and must not contain another person's personal information. You keep ownership of what you choose, and you grant us a licence to store, display, and moderate it as needed to run the service and as described in Section 6.
5. Fair Play in the Arena
League points and leaderboard positions are calculated from the training you log, including session duration, rounds, strike counts, and the combinations called during a session. Falsifying training data, tampering with the app, exploiting bugs, or using automation to gain points is cheating. We may recalculate scores, void results, remove you from a league, or suspend accounts involved in cheating.
6. Reporting, Blocking, and Enforcement
You can block any user from inside the app, which hides you from each other on leaderboards and in your league. Usernames pass through an automated filter when they are first claimed. To report a user or a username, email us at the address in Section 22 and we will review it.
We do not pre-screen or continuously monitor everything users do, and we are not obliged to. When something is reported to us, or otherwise comes to our attention, we review it and may remove or change content, restrict features, suspend, or permanently terminate an account, with or without notice. We aim to act promptly on reports of unlawful or seriously harmful material.
7. Streamer Mode
Duckin offers a Streamer Mode that pairs the app with a separate device so that certain events can be shown during a live stream. If you use it, you generate a pairing code and the paired device can display events from your session. You can revoke a pairing at any time in Settings. You are responsible for your own stream and for following the rules of the platform you stream on.
Separately, and whether or not you use Streamer Mode yourself, the username you choose when you first claim one may be shown in Duckin promotional content, including live streams, to acknowledge new members. Only the username is used. Your email address, your training data, and every other detail of your account are never shown. If you would prefer your username not to be used this way, contact us and we will exclude it.
8. Subscriptions and Purchases
Duckin Advanced and individual coaches are sold through the Apple App Store or Google Play, and your purchase is also governed by their payment terms. Prices are shown in your local currency as the store sets them, including any tax the store applies.
Duckin Advanced is a subscription, billed monthly or yearly. It renews automatically at the then-current price until you cancel it. You can cancel at any time in Settings, then Manage plan, or in your App Store or Google Play settings. Cancelling stops future renewals; you keep Advanced until the end of the period you have already paid for. On Apple, cancel at least 24 hours before the period ends to avoid the next charge. If the price of a subscription changes, the store tells you in advance as its rules require, and you can cancel before the new price applies.
Duckin does not currently offer a free trial. If one is offered in future, its terms will be shown on the plan before you subscribe.
A coach bought on its own is a one-time purchase. It stays yours if you never had, or later end, Duckin Advanced, and it can be restored on another device signed in to the same store account. Every coach is included while Advanced is active.
Deleting the app or your Duckin account does not cancel a subscription. Only Apple or Google can stop billing, so if yours is set to renew, the app asks you to cancel it before your account is deleted. Refunds are handled by Apple or Google under their policies, without limiting any rights you have under consumer law. We use RevenueCat to check purchases, as described in the Privacy Policy.
9. Your Account and Deletion
You can delete your account at any time in Settings, then Delete account. Your data is held for 30 days, during which signing back in restores it, and is then permanently erased, as described in the Privacy Policy.
Deleting your account does not cancel a subscription or refund a purchase (see Section 8). Purchases belong to your Apple or Google account, so a coach or an unexpired subscription can still be restored if you create a new Duckin account.
10. Acceptable Use
Use Duckin lawfully and only for your own personal, non-commercial training. You must not copy, modify, decompile, or reverse-engineer the app, except where the law expressly allows it; scrape, harvest, or extract its content or data; interfere with, overload, or try to gain unauthorised access to the app, our servers, or anyone else's account; get around a paywall, purchase check, or other technical limit; misuse, share, or sell promo codes where that is not permitted; or use the app to break any law or harm anyone. We may suspend or end your access if you do.
11. Our Content
The app, its design, drills, combinations, coach characters, voices, artwork, and branding belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own training under these Terms. You may not copy, resell, reverse-engineer, or build a competing dataset from the app. If you send us feedback or suggestions, we may use them without any obligation to you.
12. Third-Party Services
Duckin relies on, and links to, services we do not control, including the Apple App Store, Google Play, Sign in with Apple, the music app on your device, and video sites such as YouTube. Your use of those services is governed by their own terms, and we are not responsible for their content, availability, or conduct.
13. App Store and Google Play
If you downloaded Duckin from the Apple App Store, your licence to use the app is also governed by Apple's Standard Licensed Application End User License Agreement, and these Terms add to it. If you downloaded it from Google Play, the Google Play Terms of Service also apply.
These Terms are between you and us, not Apple or Google. Apple and Google are not responsible for the app or its content and have no obligation to provide maintenance or support for it. If the app fails to meet a warranty that applies to it, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation for the app. We, not Apple, are responsible for dealing with any claim about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, and claims that it infringes someone else's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You confirm that you are not located in a country subject to a United States government embargo and are not on any United States government list of prohibited or restricted parties.
14. Changes to Duckin and to These Terms
Duckin is run by one person and evolves quickly. We may change, pause, or withdraw features, including the Arena, leagues, and Streamer Mode. If a change materially reduces what a paid plan includes, we will tell you in the app and you can cancel, and you may be entitled to a refund where the law requires one.
We may update these Terms. If a change is material we will tell you in the app or by email before it takes effect, and the effective date at the top will change. If you do not agree, stop using Duckin and delete your account. Continuing to use Duckin after a change takes effect means you accept the updated Terms.
15. Your Consumer Rights
Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, including the consumer guarantee that services are supplied with due care and skill. Every disclaimer and limit in these Terms, including Sections 3, 16, and 17, applies only to the extent the law allows. If you live outside Australia, you also keep any mandatory consumer protection that the law of your country gives you.
16. Disclaimers
Apart from the rights described in Section 15, the app is provided "as is" and "as available". To the extent permitted by law, we give no warranty or promise that it will be uninterrupted, error-free, secure, or available on any particular device, that any estimate or statistic it shows is accurate, or that using it will produce any particular fitness, weight, health, or performance result.
17. Limitation of Liability
To the fullest extent permitted by law:
- we are not liable for any indirect, incidental, special, or consequential loss, or for any loss of profit, revenue, opportunity, or goodwill;
- we are not liable for the loss of data stored on your device, or for lost data caused by events outside our reasonable control;
- we are not liable for any loss caused by your breach of these Terms, by your own training decisions, or by a third-party service; and
- our total liability to you for all claims connected with Duckin is limited to the total amount you paid for Duckin in the 12 months before the event that gave rise to the claim.
Where the Australian Consumer Law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again. Nothing in these Terms limits liability for fraud, or any other liability that cannot be limited by law.
18. Indemnity
You agree to compensate us for any claim, loss, or cost, including reasonable legal costs, arising from a claim a third party brings against us because of your breach of these Terms or your unlawful use of the app, except to the extent the claim was caused by us.
19. Ending This Agreement
You can stop using Duckin and delete your account at any time. We may suspend or end your access if you seriously or repeatedly breach these Terms, if the law requires it, or if we stop offering Duckin. If we stop offering Duckin entirely, we will give reasonable notice where we can. Sections 3 and 15 to 21 continue to apply after this agreement ends.
20. Governing Law and Disputes
These Terms are governed by the laws of Queensland, Australia. If you have a problem with Duckin, contact us first at the address in Section 22, and we will try in good faith to resolve it within 30 days. If it is not resolved, the courts of Queensland, and courts that can hear appeals from them, have non-exclusive jurisdiction. If you are a consumer living outside Australia, this section does not take away any right the law of your country gives you to bring proceedings there, or any mandatory protection it gives you.
21. General
If any part of these Terms is found unenforceable, it is read down to the extent needed, or removed, and the rest continues to apply. If we do not enforce a right straight away, we have not given it up. We may transfer our rights and obligations under these Terms to a company or other business that takes over Duckin, including a company we set up to run it, and we will tell you if that happens; a transfer does not reduce your rights. You may not transfer your rights under these Terms. These Terms, together with the Privacy Policy and any store terms that apply, are the whole agreement between you and us about Duckin.
